Lucid Storm Software License Agreement
---------------------------------------------------------------------------------------------
This software license agreement is between Lucid Storm Software ("Lucid Storm") and you and/or your
organization ("End User") for the use of any Lucid Storm software and any
accompanying documentation.
By installing and using any Lucid Storm software, you agree to the following:
1. Lucid Storm Software is copyrighted software. You acknowledge that Lucid Storm retains ownership of the
Software and/or source code with all rights therein.
2. You are not authorized to offer the commercial use of the Software via Intranet, or
Internet beyond the End User. You may allow business partners in the process of conducting
normal business practice free access to the Software.
3. If you have purchased a "Standard" version of any Lucid Storm software, you are authorized to customize
the software for the End User’s needs. You are authorized to use the Software on as
many sites ("Site(s)"), internal or external, as you have purchased a License aggreement for.
You may add as may users to the Site(s) as you need.
You may not offer the original Software or any modification of the Software for resale under
the name Lucid Storm Software or any other name.
4. If you have purchased a "Developers-Resellers" version of any Lucid Storm Software, you are authorized to
customize the software for the purpose of resale to your clients. You may not offer the
original Software or any modification of the Software for resale under the name Lucid Storm.
You may not offer the Software or any modification to the Software as an original product
for sale or for commercial use. Lucid Storm retains ownership and copyrights to the original Software
and/or source code with all rights therein.
5. Disclaimer of Warranty and Limited Warranty
THIS SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED.
THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE SOFTWARE IS WITH YOU. SHOULD THE
SOFTWARE PROVE DEFECTIVE, YOU (NOT INTERNET 2 INTERNET) ASSUME THE ENTIRE COST OF ALL
NECESSARY SERVICING, REPAIR, OR CORRECTION.
LUCID STORM SOFTWARE DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THIS SOFTWARE WILL MEET
YOUR REQUIREMENTS OR THAT THE OPERATION OF THIS SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE.
IN NO EVENT WILL LUCID STORM SOFTWARE BE LIABLE TO YOU FOR ANY DAMAGES, INCLUDING ANY LOST
PROFITS, LOST SALES, INJURY TO PERSON OR PROPERTY OR ANY OTHER INCIDENTAL OR CONSEQUENTIAL
DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THIS SOFTWARE EVEN IF LUCID STORM SOFTWARE
OR ITS AUTHORIZED REPRESENTATIVE(S) HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES,
OR FOR ANY CLAIM BY ANY OTHER PARTY. IN NO EVENT SHALL LUCID STORM SOFTWARE’S LIABILITY
EXCEED AMOUNTS PAID TO LUCID STORM SOFTWARE BY YOU UNDER THE TERMS OF THE AGREEMENT.
6. Any activity which violates the terms of this agreement can be subject to legal actions by Lucid Storm.
These terms cannot be changed without written and signed permission from Lucid Storm Software.
